The CTA remains law, but its enforcement is suspended. The ruling has been appealed.

The December 3, 2024 ruling by a Texas District Court did NOT declare the CTA unconstitutional and the CTA has not been struck down as has been reported by many in error. Rather, the Judge granted a preliminary injunction to maintain the status quo while the case is being litigated. THE CTA remains the law. The preliminary injunction only suspends the enforcement of the CTA nationwide. There is some question between jurisdictions as to whether the judge has the authority to stay the enforcement of a federal law nationwide, but as of now, his ruling stands and there is no requirement to file a Beneficial Ownership Information Report (BOIR) with FinCEN by December 31, 2025. This ruling has been appealed.
